A patent is one of the main pillars of intellectual property for which protection can be granted by the different Patent Registries in the world.
Patent registration is to protect your innovative ownership.
A patent provides the patent holder with the legal and exclusive right to use or sell an original invention. This protection will last for a number of years (usually around 20) before the invention is released into the public domain.
What is an

Invention?

An invention is a new and original creation of a product, device, software, and just about any other physical object or method that has the potential to make a useful impact within an industry.
An invention eligible for a patent must be something that is wholly unique, original, and innovative.

What can be patented?

For your invention to be patented, it must be something that can be physically produced, has never been created before, and is not a simple spin on an existing product.
Your invention should be useful and have the potential to make a positive impact in its given industry.
Is my invention

New?

If your invention is something that has never been created before, in any way at all, then you can rest assured that it fits the ‘new’ criteria. However, it can sometimes be more complicated than this.
You cannot put your own spin on an existing product and patent it as your own, but you may be able to patent an unprecedented new use for an existing product, when the new use has never before been considered.

 Innovative?

Simply put, an innovative invention is one in which the innovative process is clear, and the product is distinctive. This means that it cannot be too similar to any other invention within the same industry and should not have a similar use to any other existing patent.
You can, however, patent an invention which improves on an existing product’s usability, though this is generally more likely to be accepted when the existing product has entered the public domain.

Useful?

Your invention may be new, original, and innovative, but it’s utilisation is a key component of its patentability, and your patent cannot be approved without it.
A ‘useful’ invention is one that works in the way that it is intended, and can make a change in the way that a specific action within an industry is achieved.
You may need to demonstrate that your product does indeed work in the way that you claim it does in order for your patent to be approved.

What Cannot Be Patented?

Things that you cannot patent include literary, dramatic, and other creative works, logos, names, and businesses.
You cannot patent a theory, a biological, medical, or scientific discovery, or any method of thinking.

Ownership / Inventorship

When ascertaining who the owner(s) of your invention are, consider whether you had any contributors to the product. If another person helped you to come up with the idea, and contributed at least one integral factor, then you will both be classed as the owners of the invention.
If you have created an invention for an employer, then the employer may be the one who holds the ownership rights.

patents are allowed:

Utility patent

This covers inventions created with a useful purpose.

Design patent

This covers the original design elements of a functional invention.

Plant patents

This covers new and original asexually produced plants.
